SpamGate — Version 1.0 · Effective 22 July 2026

These Terms of Use ("Terms") govern your installation and use of the SpamGate browser extension ("Extension"), published by Heuristicworks LLC, a Delaware limited liability company ("Heuristicworks", "we", "us", "our").

By installing the Extension or using it in any way, you agree to be bound by these Terms and all policies incorporated by reference. If you do not agree, you must uninstall the Extension immediately.

1. The Extension

1.1 What SpamGate Does

SpamGate is a Google Chrome browser extension that adds inbox-management shortcuts to Gmail. When you right-click on an email in Gmail, the Extension injects a "Spam Manager" submenu that allows you to:

  • Route messages from a specific sender email address to Trash, Spam, or the archive (Junk)
  • Route messages from an entire sending domain to Trash, Spam, or the archive
  • Retroactively apply saved rules to all existing inbox messages

The Extension creates Gmail filter rules in your Google account using the Gmail API. All rules are stored in your own Gmail account — not on Heuristicworks servers.

1.2 Distribution

The Extension is distributed through the Google Chrome Web Store. Heuristicworks LLC is the developer and publisher of record.

1.3 Service Tiers

The Extension is offered in two tiers:

  • Free: Create up to 10 sender-address filter rules. Domain-based rules are not available on the Free tier.
  • Pro ($2 USD per month or $15 USD per year): Unlimited sender-address and domain rules. Billing is managed via Stripe.

1.4 Changes to the Extension or These Terms

We reserve the right to modify the Extension, its features, or pricing at any time. For material changes to the Pro tier, we will provide at least 30 days' notice by email. We may update these Terms at any time and will post the revised Terms at trustcenter.heuristicworks.com/products/spamgate/legal/terms-of-use. Continued use of the Extension after the effective date of revised Terms constitutes acceptance.

2. Eligibility

You must be at least 18 years of age and capable of entering into a legally binding agreement to use the Extension. The Extension is not directed at children under 13.

You must have a valid Google account and access to Gmail to use the Extension. By using the Extension, you represent that your use complies with Google's Terms of Service and Gmail's Terms of Service.

The Extension is not available to persons in jurisdictions subject to comprehensive US or EU trade sanctions.

3. Google Account Access and Authorisation

3.1 OAuth Consent

To use the Extension, you must authorise it to access your Google account using Google's OAuth 2.0 flow. The Extension requests the following Gmail API scopes:

  • gmail.settings.basic — to create and manage Gmail filter rules in your account
  • gmail.modify — to move existing messages (apply labels such as Spam or Trash to matching messages)

You grant these permissions through Google's standard OAuth consent screen. You may revoke this authorisation at any time via your Google Account's "Third-party apps with account access" settings.

3.2 What the Extension Accesses

The Extension uses the Gmail API to:

  • Read your Gmail profile to obtain your email address (used to identify your account for plan lookup)
  • Create, update, and delete Gmail filter rules on your behalf
  • List inbox message IDs matching your filter criteria (for retroactive application)
  • Apply label changes (Trash, Spam, or archive) to matched messages

The Extension does not read the content, body, or attachments of your messages.

3.3 Local Data Storage

The Extension stores the following data locally in your browser using chrome.storage.local:

Plan cache Caches your subscription tier (Free/Pro) for up to 5 minutes
Pending target The sender email detected at the last right-click event
Last action The most recently applied rule, displayed in the popup

This data is stored locally on your device and is not synced across devices.

3.4 Data Sent to Heuristicworks Servers

Your Gmail email address is sent to Heuristicworks' backend service (operated on Cloudflare Workers) in two cases:

  • Plan status check: When you open the Extension popup or trigger a filter action, the Extension checks your subscription tier by sending your email address to the backend. This request is cached locally for 5 minutes.
  • Checkout initiation: If you click "Upgrade to Pro", your email address is sent to the backend to create a Stripe checkout session.

No other personal data is transmitted to Heuristicworks servers. Gmail message content is never transmitted to Heuristicworks.

4. Subscriptions and Payment (Pro Tier)

4.1 Pro Tier Pricing

The Pro tier is billed at $2.00 USD per month or $15.00 USD per year. Prices are exclusive of applicable taxes.

4.2 Billing and Payment Processor

Payments are processed by Stripe, Inc. By subscribing to the Pro tier, you agree to Stripe's terms of service and privacy policy. Heuristicworks does not store your payment card information.

4.3 Automatic Renewal

Pro subscriptions renew automatically at the end of each billing period. You may cancel at any time; cancellation takes effect at the end of the current paid period, after which your account reverts to the Free tier.

4.4 Refunds

Subscription fees are non-refundable except where required by applicable consumer protection law, or where Heuristicworks materially fails to deliver Pro tier features for more than 72 consecutive hours due to causes within our control and you request a refund within 14 days of that outage.

4.5 Free Tier Limits

The Free tier is limited to 10 sender-address filter rules. Domain-based rules require an active Pro subscription. We reserve the right to adjust Free tier limits on 30 days' notice.

5. Acceptable Use

Your use of the Extension must comply with our Acceptable Use Policy, available at trustcenter.heuristicworks.com/products/spamgate/legal/aup, which is incorporated into these Terms by reference.

You must not:

(a) Use the Extension to access, modify, or delete email that does not belong to you;

(b) Attempt to circumvent Free tier limits by creating multiple Google accounts or by any technical means;

(c) Reverse engineer, decompile, or attempt to extract source code from the Extension beyond what applicable law expressly permits;

(d) Attempt to access the Extension's backend API by means other than the Extension itself;

(e) Use the Extension in violation of Google's Terms of Service, Gmail's Terms of Service, or the Gmail API terms;

(f) Create filter rules designed to destroy evidence of criminal activity (e.g. routing email from courts or regulators to Trash to evade legal process).

6. Intellectual Property

The Extension, including its code, design, and documentation, is owned by Heuristicworks LLC and protected by copyright, trademark, and other intellectual property laws. These Terms do not transfer any ownership rights in the Extension to you.

"SpamGate" and associated marks are trademarks of Heuristicworks LLC. Google and Gmail are trademarks of Google LLC; Heuristicworks is not affiliated with or endorsed by Google.

7. Privacy

Our collection and use of your personal data is governed by our Privacy Policy at trustcenter.heuristicworks.com/enterprise/legal/privacy-policy. By using the Extension, you consent to the data practices described therein, including the transmission of your Gmail email address to our backend service for plan verification.

8. Disclaimers

THE EXTENSION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEURISTICWORKS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT: (A) THE EXTENSION WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPATIBLE WITH FUTURE VERSIONS OF CHROME OR GMAIL; (B) FILTER RULES WILL OPERATE AS INTENDED ON ALL MESSAGES; OR (C) THE EXTENSION WILL REMAIN AVAILABLE ON THE CHROME WEB STORE.

SpamGate relies on the Gmail API, operated by Google LLC. We make no warranties regarding the availability or continued operation of the Gmail API or Gmail's web interface.

FILTER RULES CREATED BY THE EXTENSION CAN PERMANENTLY MOVE OR TRASH EMAIL MESSAGES. HEURISTICWORKS IS NOT RESPONSIBLE FOR EMAIL MESSAGES MOVED, ARCHIVED, OR DELETED AS A RESULT OF FILTER RULES YOU CREATE. REVIEW YOUR RULES CAREFULLY BEFORE RUNNING RETROACTIVE ACTIONS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

(A) HEURISTICWORKS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF EMAIL MESSAGES, DATA, OR BUSINESS OPPORTUNITY, ARISING FROM YOUR USE OF OR INABILITY TO USE THE EXTENSION;

(B) HEURISTICWORKS' AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE EXTENSION SHALL NOT EXCEED THE GREATER OF: (I) THE TOTAL FEES PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM; OR (II) TEN US DOLLARS ($10).

Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

10. Indemnification

You agree to defend, indemnify, and hold harmless Heuristicworks, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of: (a) your use of the Extension in violation of these Terms; (b) your violation of Google's or any third party's terms or rights; or (c) filter rules you create that result in unintended loss of or damage to email in your account.

11. Term and Termination

11.1 Term

These Terms are effective from the date you install the Extension and continue until the Extension is uninstalled or your access is terminated.

11.2 Termination by You

You may stop using the Extension and cancel your Pro subscription at any time. Uninstalling removes the Extension from your browser but does not automatically delete the filter rules in your Gmail account or data stored in our backend. To request deletion of your backend data, contact support@heuristicworks.com.

11.3 Termination by Us

We may suspend or terminate your access to Pro features immediately, without notice or refund, if you breach these Terms, violate the AUP, engage in fraud or payment abuse, or if Google removes the Extension from the Chrome Web Store.

11.4 Effect of Termination

On termination: (a) your Pro subscription ends and your account reverts to Free tier or is deactivated; (b) filter rules previously created in your Gmail account remain in place and are not automatically deleted; (c) Sections 6, 8, 9, 10, 11.4, and 12 survive termination.

12. General

12.1 Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.

12.2 Dispute Resolution

Any dispute arising out of these Terms shall first be subject to 30 days of good-faith negotiation. If unresolved, disputes shall be resolved by binding arbitration administered by the AAA under its Commercial Arbitration Rules, in Wilmington, Delaware. Either party may seek injunctive relief in any court of competent jurisdiction to prevent irreparable harm.

12.3 Class Action Waiver

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU WAIVE ANY RIGHT TO BRING OR PARTICIPATE IN A CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING IN CONNECTION WITH THESE TERMS OR THE EXTENSION.

12.4 Entire Agreement

These Terms, together with the EULA, Privacy Policy, and AUP, constitute the entire agreement between you and Heuristicworks regarding the Extension and supersede all prior understandings.

12.5 Severability

If any provision of these Terms is found invalid or unenforceable, it will be modified minimally to make it enforceable, and the remaining provisions continue in effect.
